The necessary works

The works necessary for the maintenance of the property and its services (affecting habitability, waterproofing, security, etc.) require payment by all the owners; it is the owners' meeting that decides whether the work is really necessary. In these difficult economic times it is advisable to be prudent when assessing whether the work is indispensable, as a extraordinary bill could cause more than one neighbour to become a debtor.

Debtors

An owner who is not up to date with his payments to the community is a debtor. The debt can affect the fees for ordinary or extraordinary expenses that have been duly approved and are already payable by the members of the community. If someone does not agree with a certain expense, he must present his arguments at the general meeting. If there has been approval by the meeting and the person is still objecting, he or she can challenge the agreement in court, but the expense will already be due under the terms of the approval, even if the court later annuls the agreement.

Agreements

Agreements that require unanimity are all those that involve the approval or modification of the constitutional title or the statutes of the community. Changes to the structure of the building or common elements: construction of new floors, changes to the façade, installation of a swimming pool... Modification of the participation fees for common expenses.

By a majority of 3/5
Creation or elimination of the services like elevator, concierge, surveillance or other common services of general interest (equipment that improves the energy or water efficiency of the building...), even when they imply modification of the constitutional title or the statutes. Letting of common elements that do not have an assigned use.

By simple majority (half plus one)
Works or new services to eliminate architectural barriers that make access or mobility difficult for people with disabilities or over 70 years of age, the amount of which exceeds the equivalent of 12 months' fees.

Other agreements. At the first call, with half plus one of the owners present, it is approved with half plus one representing the majority of the quotas; at the second call, with the vote of more than half of those present.

By a majority of 1/3
Installation of telecommunications infrastructure and new energy supplies. The cost will be assumed by the individuals who approve it and those who later want to sign up.
